This website has been designed to enable use of the COPD Assessment Test in printed form whether distributed by GSK, other members of the GSK group of companies or licensees of GSK as well as in the form set out on this website.
PERMISSION TO COPY FOR PERSONAL USE, FOR CLINICAL PRACTICE, AND FOR RESEARCH PURPOSES
In this context:
- “personal use” means use by you if you are a COPD patient to describe your symptoms;
- “clinical practice” means use by you if you are a doctor, nurse, pharmacist or other care provider or healthcare professional in the direct care of your COPD patients;
- “research purposes” means any research project in the field of COPD, whether alone or in collaboration with others.
Personal Use and Clinical Practice
You may read, view, print, download and copy the material on this website as well as use and reproduce the printed version of the COPD Assessment Test and distribute such materials to others (whether the English language version or validated translation for any other language listed here or any other validated translation prepared by or with the agreement of GSK) for your personal use and/or for clinical practice but only if:
- you do not modify the COPD Assessment Test or combine it with other documents or materials (including any other logos or branding) except for limited re-formatting;
- when the test is reproduced on paper or in web format, the eight questions of the COPD Assessment Test appear verbatim, in order and together as they are presented and not divided on separate pages;
- all trade mark and copyright information must be maintained as they appear on the bottom of each page of the COPD Assessment Test on all copies of the COPD Assessment Test, and you acknowledge that intellectual property rights in the COPD Assessment Test are owned by the GSK Group of Companies; and
- you use the COPD Assessment Test in its entirety with all trade mark and copyright notices.
Research Purposes
In this section, “Researcher” means with respect to any research project, any employee, officer, consultant, student, contractor or agent of the company or institution responsible for that research project.
Any Researcher may read, view, print, download and copy the material on this website as well as use and reproduce the printed version of the COPD Assessment Test and distribute such materials to others and reproduce and use the COPD Assessment Test on an electronic patient reported outcome system (ePRO) (whether the English language version or validated translation for any other language listed here: CAT, or any other validated translation prepared by or with the agreement of GSK) for research purposes but only if:
- the Researcher does not modify the COPD Assessment Test or combine it with other documents or materials (including any other logos or branding) except for limited re-formatting;
- when the test is reproduced on paper or in web format, the eight questions of the COPD Assessment Test appear verbatim, in order and together as they are presented and not divided on separate pages;
- when the test is reproduced using an electronic patient reported outcome system (ePRO), the eight questions of the COPD Assessment Test appear verbatim, in order and use an ePRO system that is listed here: or which is otherwise agreed by GSK;
- all trade mark and copyright information must be maintained as they appear on the bottom of each page of the COPD Assessment Test on all copies of the COPD Assessment Test, and you acknowledge that intellectual property rights in the COPD Assessment Test are owned by the GSK Group of Companies; and
- the Researcher uses the COPD Assessment Test in its entirety with all trade mark and copyright notices.
The Researcher shall at all times be responsible for ensuring compliance by all Researchers involved in such research project with these Terms of Use. By accepting these Terms of Use with respect to a particular research project, you are representing and warranting to GSK that you are authorised to accept these Terms of Use for that research project on behalf of the responsible company or institution.
GSK reserves the right to revoke its permission with respect to a particular research project at any time in the event of a Researcher’s failure to comply with these Terms of Use and, upon such revocation, all Researchers involved shall cease, and procure that each third party to whom any material created pursuant to the above permission has been distributed shall cease, using, copying, reproducing and distribution of such material; however, such revocation will not affect any use by any Researchers of such material or reproduction of data acquired through the use of such material, in accordance with the permission granted herein, prior to such revocation.
Where GSK agrees that a new, validated translation of the COPD Assessment Test may be prepared, the company or institution notified to GSK may be required to bear the cost of translation, GSK will provide or facilitate developer review during the translation process and the user is required to provide the translation to GSK for inclusion in this website.
General Provisions
These permissions do not allow incorporation of the material on this website or any part of it in any other work or publication, whether in hard copy or electronic or any other form. Furthermore, these permissions do not allow any part of the site to be reproduced on or transmitted to or stored in any other web site or other form of electronic retrieval system or means of electronic data capture. However, users are free to publish (whether as a poster, manuscript or otherwise) any data obtained using the COPD Assessment Test in accordance with these Terms of Use.
COPYING AND USE FOR OTHER PURPOSES
GSK supported the development of the COPD Assessment Test and is committed to facilitating its broad adoption for the benefit of patients and their healthcare providers.
In general GSK is willing to give permission for the reproduction and use of the COPD Assessment Test for purposes beyond those covered above.
This includes use in research sponsored or supported by other businesses and distribution of copies of the COPD Assessment Test where permission will generally be given free-of-charge although the user may be required to bear the cost of translation of the COPD Assessment Test where a version is not already available in the language required.
This also includes use by healthcare management organisations (HMOs), hospitals, government healthcare systems to collect data in electronic medical records or patient management plans where permission will generally be given free-of-charge although GSK may seek a fee where data derived from primary patients’ data is used for commercial purposes. Furthermore, GSK may seek access to anonymized primary data from research studies that could support qualification by regulatory authorities of the COPD Assessment Test as a drug development tool for clinical research.
In each of these further cases, such permission is conditional upon signature of an agreement between GSK and the person or entity wishing to make extended use of the COPD Assessment Test. Please contact GSK RD.CATmailbox@gsk.com. for further information.
NO WARRANTY
GSK makes no representation that material in the site is appropriate or available for use outside of the UK. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent that local laws are applicable.
GSK uses reasonable efforts to update the website, but makes no representation or warranty in respect of accuracy or lack of errors.
Use of the site is at the risk of the user. GSK takes no responsibility for direct, indirect or consequential loss from use of this site and all implied warranties are excluded to the extent permissible under English law.
